What Legal Issues Come From Using A.I.
Oct 30, 2026Nearly every small business is using artificial intelligence. Many use it without knowing the legal ramifications. At the Phoenix Fridays Leadership Power Hour, Amy Goldsmith, an intellectual property attorney in New York, provided some insights into using A.I.
- Use Business Level of Software – The business level of the different A.I. softwares provide more protections than the personal accounts, which could be important if an issue arises. If the A.I. fails to stay within the parameters you set, the personal accounts do not give the business owner any legal protection, she said.
- Keep Questions Private – When you are using it for ideas, do not allow it to search the Internet or have a global presence. Do not add your content to it and ask basics. Keep questions private so it can’t share your content with the world. Even if you ask it not to share the content, it still might. Also, periodically check that it is staying private. Even if you ask it to be private, A.I. could go out into the world anyway.
- Check for Plagiarism – Even if you tell the A.I. to avoid plagiarizing others and to use only content you provide, it might still take from someone else’s work. Grammarly has a function that checks for plagiarism. You should use it regularly when asking A.I. to create content for you. Several copyright infringement cases are in courts right now. Nothing has been resolved regarding violating copyrights of others. Some cases have ended due to settlements, but, according to Amy, the issues remain, especially with pictures. Use a subscription when having pictures.
- Be Careful Building Websites or Writing Content – Many business owners know that their assets include an e-mail list and a website. Social media content is owned by the platform where you place that content, but your blog and website material should be yours. This is not the case if you allow A.I. to create your website because it is convenient. No one owns that website in that case. No one owns the content. The U.S. Copyright Office requires authorship to be a human. If you do not own the content on the website, it could be shared worldwide. You also lose a valuable asset to your company evaluation. When using contractors, make sure you get an agreement and ask them to not use A.I. to create your content.
- If Unsure, Double Check – You should not trust A.I. to provide you exactly what you want. If you think it might have stolen information, double-check. You should run your content through something that can check or ask a professional to check for you.
